Terms and Conditions

Welcome to Frank & The Driver, operated by Frank The Vizsla LLC. These Terms and Conditions ("Terms") govern your use of our dog park shuttle service in Port Charlotte, Punta Gorda, Englewood, North Port, and Boca Grande, Florida. By subscribing to our services, including our $75 One-Week or $175 One-Month subscription plans, or using our website or mobile app, you agree to these Terms. Please read them carefully, and if you have any questions, contact us at contact@frankthebusdriver.com.

1. Description of Services

Frank & The Bus Driver provides a transportation service for dogs to local dog parks or dog-friendly parks for exercise and socialization. Our services include:

  • Pickup and drop-off at your chosen location by Frank (our Hungarian Vizsla mascot) and The Driver (company owner), using a double leash for safety.

  • Transportation to a dog park or dog-friendly park for approximately 1 hour of supervised play.

We are not dog trainers or behavior modification specialists. Our service is strictly limited to transportation and supervised park visits. We do not provide training, grooming, veterinary care, or other services.

2. Subscription Plans

We offer two subscription plans, payable upfront:

  • One-Week Subscription: $100 for unlimited rides for 1 week.

  • One-Month Subscription: $200 for unlimited rides for 1 month.

  • Three-Month Subscription: $300 for unlimited rides for 3 month.

Subscriptions auto-renew unless canceled at least 48 hours before the renewal date. No refunds are provided for unused portions of a subscription, except as outlined in Section 4.

3. Eligibility and Responsibilities

To use our services, you must:

  • Be at least 18 years old and legally able to enter contracts.

  • Provide accurate information (e.g., name, address, contact details, dog’s vaccination records).

  • Sign a liability waiver acknowledging risks associated with dog transport and park activities.

  • Ensure your dog is up-to-date on all required vaccinations (e.g., rabies, bordetella), as verified by veterinary records submitted to us.

Dog Owner Responsibilities:

  • You are solely responsible for your dog’s behavior and any injuries or damages caused by your dog to other dogs, people, or property during transport or at the park.

  • You must provide a suitable pickup location accessible to our shuttle bus.

4. Behavioral Policy and Subscription Termination

We reserve the right to refuse service or terminate your subscription if your dog exhibits behavior deemed aggressive, uncontrollable, or excessive by Frank The Vizsla LLC, including but not limited to:

  • Biting or attacking other dogs or people.

  • Excessive barking or disruption during transport.

  • Behavior posing a safety risk to other dogs, passengers, or The Driver.

In such cases, we will:

  • Notify you immediately and provide a prorated refund for the unused portion of your subscription, calculated based on the remaining days.

  • Cease transporting your dog, effective immediately.

5. Liability and Indemnification

Limitation of Liability: Frank The Vizsla LLC, its owner, and employees (including The Driver) shall not be liable for any injuries, damages, or losses to your dog, other dogs, people, or property caused by your dog’s actions during transport or at the park, except in cases of gross negligence or willful misconduct by the Company.

Dog Owner Liability: You agree to indemnify and hold harmless Frank The Vizsla LLC, its owner, and employees from any claims, damages, or liabilities arising from your dog’s behavior, including injuries to other dogs, people, or property.

Risk Acknowledgment: You acknowledge that dog park activities and transportation involve inherent risks (e.g., dog fights, injuries). By signing our liability waiver, you assume these risks and release the Company from liability.

6. Payment and Billing

Subscriptions are paid upfront via our website or app, processed securely through Wix Payments or third-party processors (e.g., Stripe). You agree to:

  • Provide accurate payment information.

  • Authorize recurring payments for auto-renewing subscriptions.

  • Pay any applicable transaction fees (~2.9% + $0.30 per transaction).

Failure to pay may result in suspension of services until payment is received.

7. Cancellation and Refunds

Cancellation by You: You may cancel your subscription at any time via your account or by contacting us at contact@frankthebusdriver.com. No refunds are provided for unused portions, except as noted in Section 4.

Cancellation by Us: We may cancel your subscription for reasons including, but not limited to, non-payment, violation of these Terms, or aggressive dog behavior (per Section 4). Prorated refunds will be issued if applicable.

8. Safety and Operational Policies

We prioritize safety for all dogs and passengers:

  • All dogs are secured with a double leash during pickup/drop-off, per our safety protocol.

  • The Driver supervises dogs at the park to ensure a safe and fun environment.

  • Our bus is equipped for up to 24 dogs per loop, ventilation, air conditioning, water, and kibble for comfort.

  • We comply with Charlotte County regulations for commercial vehicle operations and animal transport.

9. Intellectual Property

All content on our website and app, including logos, images of Frank and Fiona (our Husky decal), and text (e.g., “Our Story”), is the property of Frank The Vizsla LLC. You may not use, reproduce, or distribute this content without our written permission.

10. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of Florida. Any disputes arising from these Terms or our services shall be resolved through negotiation in good faith. If unresolved, disputes will be adjudicated in the courts of Charlotte County, Florida.

11. Changes to These Terms

We may update these Terms to reflect changes in our services or legal requirements. We’ll notify you via email or a website notice at least 30 days before changes take effect. Continued use of our services constitutes acceptance of the updated Terms.
